Artepedia is registered association (Verein) number 647133820 in the district of Baden, Austria. Artepedia has its principal place of business in Baden, Austria.

Conditions of Use

Anyone ("anyone" includes but is not limited to individuals, more than one person, companies, organizations, any entities of any kind) reading, submitting information ("information" includes but is not limited to text, nontext material, advertising, and announcements of events) to or posting ("posting" and associated words (post, posted, etc.) refers to both anyone directly posting on Artepedia and Artepedia posting for anyone on Artepedia) information on Artepedia agrees to all of the conditions below.

Accuracy of Information and Postings

ARTEPEDIA WILL NOT CHECK THE TRUTH, ACCURACY, OR COMPLETENESS OF ANY INFORMATION SUBMITTED TO OR POSTED ON ARTEPEDIA. IF THE TRUTHFULNESS, ACCURACY, OR COMPLETENESS OF ANY INFORMATION ON ARTEPEDIA IS IMPORTANT TO ANYONE FOR ANY REASON, THEN THAT INFORMATION SHOULD BE CHECKED BEFORE ANYONE RELIES ON IT IN ANY WAY.

Names and Other Information

Anyone submitting information to Artepedia or posting on Artepedia shall provide their real name and other information.

Grant of Nonexclusive Worldwide License

Anyone submitting information to or posting information on Artepedia grants Artepedia a nonexclusive worldwide license in the information submitted, unless agreed to in writing signed by both the submitter and Artepedia prior to such information being submitted to or posted on Artepedia.

Duties of Submitters and Posters

Anyone submitting information to or posting information on Artepedia,

• is claiming that both the submitter or poster and Artepedia have the legal right to use and reproduce such information in such manner as submitted and that neither the submitter nor Artepedia are violating any laws, treaties, judgments, decrees, injunctions, writs or orders of any court, governmental agency or authority or any rules, regulations, orders, directives, licenses and permits of any governmental body, instrumentality, agency, or authority applicable to the submitter or Artepedia by posting such information on Artepedia and

• acknowledges that neither Artepedia, nor any person or entity employed by, doing business with, or associated with Artepedia, will, or has any obligation to, ascertain whether the submitter's or poster's assertion is in fact correct nor to check the truthfulness, accuracy, or completeness of the submitter 's submission.

• will promptly and completely indemnify and hold harmless Artepedia, or anyone employed by, doing business with, or associated with Artepedia, from any loss or expense (including legal fees and expenses) of any kind whatsoever imposed on or incurred by Artepedia, and any person or entity employed by, doing business with, or associated with Artepedia, arising from or related to the submitter's or poster's submissions, posts, or any action of such submitter or poster. Artepedia has no liability to anyone resulting from any transaction between anyone whose information is submitted to or posted on Artepedia and anyone else.

Acceptance or Posting Gives No Rights

Neither Artepedia's acceptance of information submitted by anyone nor the posting of such information on Artepedia gives anyone any rights in Artepedia or its conduct or management.

Refusal to Accept Information or to Post

• At any time and for any reason, Artepedia may, in its sole discretion, refuse to accept any submitted information or to allow the posting of any information on Artepedia.

• Artepedia is not required to provide anyone with any reasons for any refusal.

• Artepedia is not required to provide notice to anyone prior to or after for any refusal.

• The fact that Artepedia previously accepted any submitted information or allowed the posting of any information on Artepedia does not obligate Artepedia to accept any subsequently submitted information or to allow any subsequent posting of any information on Artepedia.

Removal of Posts

• At any time and for any reason, Artepedia may, in its sole discretion, remove ("remove" includes both partial and complete removal) from Artepedia any information, including but not limited to announcements of events and advertising.

• Artepedia is not required to provide anyone with any reasons for any removal.

• Artepedia is not required to provide notice to anyone prior to or after removing any information from Artepedia.

• If Artepedia does remove any information, the submitter's or poster's sole claim against Artepedia will be for the return of any money paid to Artepedia for the processing or posting of such information, if any, less any money owed to Artepedia for the time that the information appeared on Artepedia and any processing costs incurred by Artepedia.

Artepedia's Liability

Artepedia has no liability to anyone who submits information to or posts information on Artepedia (other than the return of any money paid to Artepedia for the posting of such information, if any, less any money owed to Artepedia for the time that the information appeared on Artepedia and any processing costs incurred by Artepedia) for any damage or injury of any kind whatsoever, including damage to reputation or economic loss resulting from the removal from or nonappearance on Artepedia of any or all of the information submitted or any other action or inaction by Artepedia, whether resulting from intentional action, administrative error, or technical malfunction of any kind.

Demand for Removal of Posted Information

• Anyone demanding that Artepedia remove any information from Artepedia must, as a condition of such removal, in writing indemnify and hold harmless Artepedia from any loss or expense (including legal fees and expenses) of any kind whatsoever imposed on or incurred by Artepedia, or anyone employed by, doing business with, or associated with Artepedia, resulting from Artepedia complying with such demand.

• Artepedia may, at its sole discretion, require anyone demanding such removal to provide Artepedia with a detailed written explanation of the legal grounds for such demand prior to any removal.

Choice of Law, Jurisdiction

• ANYONE SUBMITTING ANYTHING TO OR POSTING ANYTHING ON ARTEPEDIA AND AT ANY TIME HAVING A DISPUTE WITH ARTEPEDIA EXPRESSLY AGREES THAT THE DISPUTE SHALL BE GOVERNED AND CONSTRUED SOLELY IN ACCORDANCE WITH AUSTRIAN LAW AND SHALL BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE LANDESGERICHT FÜR ZIVILRECHTSSACHEN IN VIENNA, AUSTRIA.

• IF FOR ANY REASON A COURT NOT LOCATED IN VIENNA, AUSTRIA IS DEEMED TO HAVE JURISDICTION OVER ANY DISPUTE WITH ARTEPEDIA, THEN THE PARTIES TO THE DISPUTE AGREE THAT THE DISPUTE WILL BE ARBITRATED IN THE CITY WHERE SUCH COURT IS LOCATED OR THE CLOSEST CITY WHERE PROFESSIONAL ARBITRATION IS AVAILABLE.

• THE LANGUAGE OF SUCH ARBITRATION WILL BE ENGLISH AND THE GOVERNING LAW AUSTRIAN.

• UNDER NO CIRCUMSTANCES SHALL ARTEPEDIA BE HELD LIABLE FOR CONSEQUENTIAL OR PUNITIVE DAMAGES.

Amendment

These Conditions of Use may only be altered or waived expressly and in a writing signed by Artepedia.

Complete Agreement

Unless otherwise expressly agreed in a writing signed by Artepedia, these Conditions of Use are the entire agreement between anyone reading Artepedia, submitting information to, or posting on Artepedia.

Partial Invalidity

If any part of these Conditions of Use are determined by the Landesgericht für Zivilrechtssachen Vienna, Austria, or other competent authority, to be prohibited or unenforceable, that part shall be ineffective to the extent stated by the court or other competent authority, but the rest of these Conditions of Use shall remain fully valid and enforceable.

Language

These Conditions of Use were written in US English. To the extent any translated version, on Artepedia or elsewhere, of these Conditions of Use conflict with this English version, the provisions of this English version govern.

Communication

Except as otherwise specifically provided in these Conditions of Use, all communication with Artepedia shall be in writing (e-mail, Fax, first class letter) and in the English language.

Trademarks, etc.

• Any of the trademarks, service marks, collective marks, design rights, or similar rights that are mentioned, used, or cited in the articles of the Artepedia encyclopedia are the property of their respective owners.

• Artepedia cannot and does not grant any rights to use any such trademarks, service marks, collective marks, design rights, or similar rights or any information protected by them.
